Judge Slams the Door on Trump's Gateway Funding Freeze

A federal judge has permanently barred the Trump administration from withholding money for the Gateway Hudson Tunnel Project, delivering a decisive win to New York and New Jersey and lifting the legal cloud that had hung over the largest federal rail investment in modern history.

In a June 29 ruling, U.S. District Judge Jeannette A. Vargas vacated the administration's September 2025 funding suspension and permanently enjoined the U.S. Department of Transportation from relying on it going forward, converting the temporary order she issued in February into a final judgment on the merits. The decision restores certainty to a $16 billion effort to bore new rail tunnels beneath the Hudson River, a chokepoint on Amtrak's Northeast Corridor where the century-old existing tunnels are running on borrowed time.

The freeze traced back to last autumn, when USDOT halted disbursements pending a review of the project's compliance with disadvantaged-business contracting rules. President Trump made little secret of the politics, at one point tying the decision to his grievances with Democrats. Vargas was unpersuaded by the legal footing: the department, she found, suspended already-obligated grants without first determining any actual violation and without giving the commission a chance to respond, contrary to law.

The administration had argued the fight belonged in the Court of Federal Claims because it stemmed from grant agreements. Vargas rejected that, writing that the states were challenging USDOT's compliance with federal regulations, not the terms of the funding itself.

For now, construction presses ahead, with roughly 1,000 workers back on the job and the commission holding to a 2035 service target. USDOT said it remains committed to responsible spending, leaving open the question of a possible appeal. But after months of stop-start turmoil, the ruling gives one of the nation's most consequential infrastructure projects something it has lacked: a clear track forward.
